Buying property in Bali – for foreigners

The Indonesian government restricts foreigners from directly owning land / property in the country, but there are alternative arrangements that allow foreign nationals to invest. It is important to note that regulations may change, so it’s advisable to consult with a legal professional or an authorized notary in Bali for the latest information. Here are common methods for foreigners to invest in property in Bali:

Leasehold agreement

Foreigners can enter into a leasehold agreement to use land for a specified period, typically up to 25 or 30 years, with an option to extend. The land is not owned but leased.

Right to Use (Hak Pakai)

This is a right-to-use title that allows foreigners to use land for residential or business purposes for up to 25 years, with possible extensions. The land remains in the name of the Indonesian owner.

Nominee Structure

Some foreigners use a nominee structure, where an Indonesian nominee holds the title on behalf of the foreigner. However, this approach has legal risks and is subject to scrutiny.

Investing through an Indonesian Company (PT PMA)

Foreigners can establish a foreign-owned company (PT PMA) to hold and own property in Indonesia. The company, however, needs to comply with local regulations.
